    New President of the Community Plant Variety Office takes up office

    On 01 February 2022, Francesco Mattina took up his duties as President of the Community Plant Variety Office (CPVO), the European Union (EU) agency responsible for granting plant variety rights, after being appointed to this role by the Council of the European Union on 20 December 2021.

    Francesco Mattina, a 51-year-old Italian national specialised in EU law and in Intellectual Property law, joined the CPVO in 2013 after gaining international experience in private law firms as a partner and in the EU public sector as a senior legal advisor in industrial property at the EU Agency

    Duration of Community Plant Variety Protection extended from 25 to 30 years for certain species

    By Regulation (EU) 2021/1873 of the European Parliament and of the Council of 20 October 2021, the term of protection of the Community plant variety rights for varieties of the species Asparagus officinalis L. and of the species groups flower bulbs, woody small fruits and woody ornamentals has been extended by five years. The duration of the Community plant variety rights will, therefore, be extended from 25 to 30 years.

    Announcement n◦ 7/2021 of the Community Plant Variety Office. Decision of the Administrative Council of the Community Plant Variety Office on test guidelines 07/10/2021

    Technical examinations which are initiated or are to be approved by the Community Plant Variety Office must be performed in accordance with the test guidelines which have been adopted by the Administrative Council. Technical examinations started prior to the decision are not affected unless otherwise announced. The plant species concerned as well as the date of the decision are accordingly published in the Official Gazette of the Office.     New guidelines on the suitability of variety denominations and revision of the explanatory notes

    The CPVO wishes to inform applicants and stakeholders that new CPVO guidelines on variety denominations will become applicable as of 1 January 2022.

    A variety denomination is the generic name of a plant variety. In the framework of a CPVR application, the applicant must submit a suitable denomination for his new variety. To be suitable, the variety denomination must comply with the requirements of Article 63 of Regulation No 2100/94 (the Basic Regulation).

    CPVO and LUISS School of Law sign cooperation agreement

    Reinforcing the relationships between the Community Plant Variety Office (CPVO) and leading universities from across Europe is important in order to explain and promote the values, benefits and challenges of plant variety protection to a greater number of law students and professionals in the field of intellectual property rights.

    Simplification of notifications regarding non-payment of fees as of 1st January 2022

    In order to answer several external queries and to streamline its official communication with all users, the CPVO wishes to bring clarity as regards the cancellation notifications for non-payment of fees.

    According to Article 83(2) Regulation 2100/1994, the CPVO shall send one official reminder to right-holders or their procedural representatives once the deadline to perform the payment of the fee for protected varieties has expired. This official reminder is sent via MyPVR for electronic users and by registered mail with recorded delivery for paper-based users. It contains a new

    European Parliament resolution on the EU Commission’s Intellectual Property Action Plan for Recovery and Resilience

    On 11 November, the European Parliament (EP) adopted with a large majority (454 votes for, 94 against and 23 abstentions) a resolution in response to the Commission’s EU Intellectual Property Action plan.

    In its resolution, the EP presents a series of recommendations for upcoming EU initiatives in the field of intellectual property rights and emphasises that the protection and enforcement of intellectual property rights are of great importance for the European economy and for the recovery and resilience of the EU, especially in view of the Covid-19

    Presentation of the CPVO at the European Parliament's AGRI Committee

    On Tuesday 30 November 2021, Members of the European Parliament from the Agriculture and Rural Development committee (AGRI) held an exchange of views with Mr Francesco Mattina, Acting President of the Community Plant Variety Office, and with representatives of the European Commission.
