Summary of the Final Report of the Ad Hoc Legal Working Group (LWG)

The LWG (Legal Working Group), established by the AC in March 2012, concluded the tasks for which it was created in January 2015. The LWG has met 8 times to exchange views on legal matters and form concrete proposals. Its members have participated in their personal capacity as experts not representing the Member State (MS) or organization they work for.

A final report was prepared and presented to the AC members in March 2015 providing them with the state of play on each of the 20 items discussed and a proposed way forward. It has not been approved by the AC and is available upon

New designation of procedural representative form

Please note that a new Designation of procedural representative form has been released.

It is only available in English but will be in Dutch, French, German and Spanish in the coming days.

Please note that a procedural representative can only surrender a Community Plant Variety Right on behalf of the holder, provided the credentials explicitly refer to the right to surrender in the name of the holder.

To that effect the surrender box on the designation of procedural representative form would need to be ticked.

Please note also that a new version of all technical questionnaires has been published in which the question about geographical origin has been removed. Please make sure to use the new application form on which the geographical origin question appears.

Denominations of plant varieties and absolute grounds for refusal of CTM applications

With decisions of 15 October 2015 the First Board of Appeal of the OHIM has dealt with six cases, namely R 279/2014-1, Silverado, R 280/2014-1, Goldrush, R 528/2014-1, Geisha, R 691/2014-1, Wasabi, R 894/2014-1, Skyfire; R 895/2014-1, Ice Tea (CPVO Case-law database)

With these decisions the Board of Appeal of the OHIM has clarified its approach regarding the refusal of applications for CTMs due to their identity with already registered denominations of plant varieties.

In preparation of the decisions, on 27 April 2015 the Board of Appeal had a public oral hearing with
