Update on fees regulations

The Commission Implementing Regulation (EU) 2016/2141 of 6 December 2016 amending Regulation (EC) No 1238/95 as regards the level of the annual fee and of the examination fees payable to the CPVO has been published in the Official Journal of the EU L332/13 of 7 December 2016. It will enter into force twenty days after the publication date. The new fees will apply from 1 January 2017.

IPM ESSEN 2017: 35th World's Leading Fair for Horticulture

From January 24 to 27, 2017, the CPVO will present at IPM ESSEN all about EU plant breeders' rights together with the Bundessortenamt (BSA), the French Variety and seed study and control group (GEVES), the National Institute of Agricultural Botany (NIAB) and the Netherlands Inspection Service for Horticulture (Naktuinbouw) for technical examinations (Hall 2.0 Stand 2B23).

CPVO hosting the 47th session of the UPOV Technical Working Party on Fruits (TWF)

The Community Plant Variety Office will host the 47th session of the Technical Working Party on Fruits (TWF) organized by the International Union for the Protection of New Varieties of Plants (UPOV), an intergovernmental organization based in Geneva. This event will take place in Angers from 14 to 18 November 2016.

Commission Notice on the interpretation of certain articles of the Biotech Directive

On 3 November the Commission adopted a notice clarifying certain articles of Directive 98/44 on the protection of biotechnical inventions. The Directive focuses on patenting in the biotech industry. The notice states that products created through essential biological processes should be excluded from patentability. Furthermore, it calls for more analysis of compulsory cross licensing between plant variety rights and patenting. The Commission also expands on how the Directive ensures that there is enough fair access to patented material of biological origin. Although a Commission Notice is

General Guidelines on how to interpret the novelty requirements

The Administrative Council of the CPVO has adopted General Guidelines on the interpretation of the novelty requirement pursuant to Article 10 of Council Regulation (EC) 2100/94 on CPVR (the Basic Regulation). The purpose of the General Guidelines is to provide a uniform interpretation of the concept of sale to which reference is made under Article 10 of the Basic Regulation.

Creation of a new organisation - TystofteFoundation

Plant patenting and plant variety protection, an exchange on practices

The Community Plant Variety Office was pleased to host a workshop with many officials of the European Patent Office (EPO) in Angers on 21 and 22 September.

This workshop was organised in the framework of the Administrative arrangement signed between the CPVO and the EPO on 11 February 2016 in which the two organisations agreed to further strengthen their relationship through the exchange of information in the area of plant-related patents and plant variety rights.
